Judicial Legislation

By Editor

WE quote above from an editorial in the New York World as to what the recall of judges means; namely, a revolution. But the late decisions of the Supreme Court in the dissolution of the Standard Oil Company and the Tobacco Trust will probably aid materially in pushing the recall of judges. The Tobacco Trust is held to be a combination in restraint of trade, a monopoly in violation of law, and is therefore dissolved, thereby affecting sixty-five American and two English corporations. The trust was held to be guilty of intimidation, "guilty of conscious wrong-doing;" yet the court remands the case to the circuit court to allow it the opportunity to disintegrate and recombine under conditions "not repugnant to law." The court is unanimous in the dissolution of the Tobacco Trust, as in the dissolution of the Standard Oil Company; but from certain things in both decisions Justice Harlan vigorously dissents. He believes that in these two cases the Supreme Court by judicial legislation in effect amends an act of Congress relating to a subject over which that department of the Government has exclusive cognizance.

Referring to past decisions of the court in which the purpose of Congress was ascertained, Justice Harlan says:

They did not grope about in darkness, but in discharging the solemn duty put on them by the Constitution, they stood out, with minds unmystified, in the full glare of the light of reason, and felt and said time and again that the court could not and ought not under the Constitution to usurp the functions of Congress by indulging in judicial legislation.

Again he says:

The evidence in the record is, I think, abundant to enable the court to render a decree containing all necessary details that will effectually suppress the evils of the combination in question. But the court sends the case back with directions to further hear the parties so as to ascertain whether a new condition can not be created in harmony with the law.

I have found nothing in the record which makes me at all anxious to perpetuate any new combination among those companies that the court concedes had at all times exhibited a conscious wrong-doing.

A senator is quoted as saying:

A justice of the Supreme Court from the bench denounces judicial usurpation by his associates; two senators on the floor of the chamber warn their fellow members that the body must purge itself and restore representative government; another, addressing a class of law graduates, forewarns the nation of Socialism and possible anarchy. Income tax amendments, popular election amendments, are being pressed; election machinery is being taken into the hands of the people; the great captains of industry are falling out and telling on each other. The truth is that the people of the United States are in the throes of a tremendous revolution and do not realize it.

Passing of President Diaz

By Editor

Read our timely article on the "Passing of President Diaz," by one well informed. It may help some of our readers to look upon the aged and truly great man more charitably. It was a fitting ending to a stormy career that he led personally to victory 300 troops against 700 rebels.

Living the Momentary Life

Failure to live the momentary life brings sore defeat and discouragement in hearts that long to be faithful. We mean to be true. Our impulses frequently rise to great longings of heart; but they are let down again, and we yield to temptation. Form habits of constancy. Dwell on the presence of God. Live as in His sight. Pray the prayer of the psalmist of old, "Create in me a clean heart, O God; and renew a right [steadfast, constant] spirit within me."

The Busiest Summer Before Us

By Editor

At a recent Sunday morning chapel service, Mr. C. H. Jones, our general manager, gave us an outline of the work that we have in hand in the office at the present time. Several editions of 10,000 each of some of our largest subscription books will have to be printed right away. A large number of smaller works are also pressing themselves upon us for immediate printing orders. We have definite plans laid for the special "Missions" issue of the weekly SIGNS OF THE TIMES, and advance orders for 500,000 copies of this edition are already in hand, with the prospects of at least 200,000 more. The manager's closing statement was:

"We have the busiest summer before us in all our history. We will have to do careful planning and faithful work in all our departments if we get all this volume of work through without any of it being delayed. We are glad that our own denominational work is crowding us so that we have no time to be even tempted to do commercial printing."

The Recall of Judges.

By Editor

The New York World clearly points out that the demand for the recall of judges "is not confined to judges who disgrace their office. Any judge may be removed at any time for any cause, or for no cause, in the whim or passion of the majority." It further says: "The prohibitions of the various constitutions are restraints which the people have imposed upon their own powers. The Bill of Rights is the guarantee of the weak against the strong, of the minority against the majority. When these guarantees are destroyed, the foundations of human liberty are destroyed." And the World further contends that all these similar demands together mean "a revolution in our system of government. The checks and balances are overturned. The barriers against sudden outbursts of popular passion are thrown down. The majority can do what it will. The minority has no rights which the majority is bound to respect." These are wise, thoughtful words, which ought to be weighed.

In the Outlook Department

By Editor

We shall publish from time to time the following articles of great and thrilling interest to students of world conditions. You will wish to read them. You will wish your neighbors to read them.

The following from our well-known contributor, Prof. G. W. Rine:

The Peace Propaganda — a Momentous Movement.

Will It Be Peace or War?

Wanton Extravagance in Government.

Ultra Extravagance in Domestic and Social Life.

The following from another well-known contributor, Pastor C. L. Taylor, on the religious outlook:

A Lowered Church Standard.

A Discounted Bible.

What Will Be the Outcome?

Our London Letter, and news of importance from all parts of the world.

The above noted articles may not appear in this order, but they will all appear within this present series, with others of equal importance on world conditions, from India, the Orient, and the Near East.

Our Missions Department

By Editor

WE are now furnishing our readers some excellent articles on China, by our superintendent of the great Oriental field, Pastor I. H. Evans. They are instructive and helpful.

From the head of our mission work in Burma, Pastor H. H. Votaw, come four articles on that field of wonderful interest in mission work, consecrated in suffering, especially by Judson and his wives.

Another article waits from Peru. And more are coming all the time.

The Viewpoint for True Progress

There is and must be progress in God's work. There is or should be ever broader, clearer vision of what His work means, of its exceeding breadth, depth, and greatness. But the place, the view-point, from which one gets his vision, is mightily important. He who views God's work from a denominational creed environment is too narrow. He who views it from a semi-world view, from a religio-political standpoint, has turned his face toward the Dark Ages, tho he may not see the end through the mist and fog of human devisings. The progress of such a plan is downward. But he who gets up into the mountain of God's holiness, and sees "visions of God" in the light of prophecy, and is "not disobedient to the heavenly vision," will make true progress.

Increase of Crime.

By Editor

The New York Independent of May 25 says editorially, "However the experts may differ about the causes of crime or the expedient methods of dealing with criminals, they agree that crime of the greatest description is rampant in American communities, and apparently is steadily increasing in ratio to population."

It further says: "The American public regards crime lightly. It is in fact amazingly indifferent to crime and its prevention."

Referring to the recent New York conference, the editor says: "Mr. Heney of San Francisco . . . made clear the absurdity of expecting to stamp out criminality among the ignorant, degraded, and poverty-stricken, so long as criminality among the powerful and socially respectable goes unpunished."

President Taft and Assistant District Attorney Nott, of New York, "were unequivocal in their showing that a percentage of American lawyers and of American judges [the percentage] by no means negligible, are themselves so thoroly criminal in character, if not technically at law, as to make our bench and bar largely and gravely responsible for the increase in crime."

In the same issue of the above journal Mr. J. C. Bayles, M.E. Ph.D., avouched by the editor as a high authority, declares that "crime [in New York] is notably on the increase, and vice . . . is better organized, more amply capitalized, and more lucrative than ever before. Very similar conditions are found in many cities. In Chicago, for example, they are worse than New York has ever known."

Doubtless, as above quoted, lawyers and judges are to an extent responsible; but what shall we say of the ministers of religion whose attitude toward God's eternal law is such as to foster sin and crime? If God's law is nothing, why should we regard the law of men? Yet these very conditions God has foretold. See 1 Tim. 3:1-5.
